THE CUSTOMER AGREES TO THE FOLLOWING:

  1. a) This Contract constitutes the entire agreement between the customer and J&D Fasteners CC (hereinafter referred to as “J&D Fasteners”). No modifications or additions to this Contract shall be valid unless agreed upon by both parties, documented in writing, and signed by both the customer and a duly authorized representative of J&D Fasteners

       b) This agreement will govern all future contractual relationships between the parties.

       c) This agreement is applicable to all existing debts between the parties.

    1. The customer acknowledges that they have read and understood each term of this agreement and accepts them as binding.

    2. The customer warrants that the signatory on the reverse side of this document is duly authorized to enter into this contract on behalf of the customer.

    3. The signatory binds themselves personally as a co-debtor for the full amount due to J&D Fasteners and agrees that these Standard Conditions will apply to them mutatis mutandis.

J&D Fasteners is entitled to:

  1. i) Institute legal action against the customer at their expense, or
  2. ii) Cancel the agreement, repossess any delivered goods, and claim damages.
  3. The customer agrees that the amount due to J&D Fasteners will be determined and verified by a certificate issued by J&D Fasteners and signed by an authorized representative. Such certificates will be binding and serve as prima facie proof of the customer’s indebtedness.
  1. Interest on any overdue amounts shall accrue at the maximum legal interest rate prescribed by the Usury Act from the due date. In cases of late payment, interest will be calculated from the date of the order.

15.1 In the event of cancellation, the customer shall be liable to pay:

  1. a) The difference between the selling price and the value of the goods at the time of repossession, and
  2. b) All other costs incurred in the repossession of the goods. The value of repossessed goods will be determined by a sworn valuer, whose valuation will be conclusive proof of the value.

15.2 The customer indemnifies J&D Fasteners against any damage related to the removal of repossessed goods.

  1. All goods supplied by J&D Fasteners remain the property of J&D Fasteners until fully paid for. The customer may not sell or dispose of any unpaid goods without prior consent from J&D Fasteners.

17.1 The customer shall be liable for J&D Fasteners’ legal expenses (including collection fees) on an attorney-and-client basis in the event of:

  1. a) Any litigation regarding the validity and enforceability of this agreement. The customer will also be liable for any collection or valuation fees incurred.

17.2 The customer agrees that J&D Fasteners is not required to provide security in terms of Rule 62 of the Magistrate’s Court.

  1. The customer agrees that any leniency shown by J&D Fasteners in enforcing the terms of this agreement or its rights does not constitute a waiver of any rights under this Contract. J&D Fasteners retains the right to enforce its rights at any time.
  2. J&D Fasteners may institute legal action in either the Magistrate’s Court or the Supreme Court at its discretion.

20.1 Any document will be deemed duly presented to the customer within:

  1. i) 3 days of being sent via prepaid registered mail to any business or postal address, or personal address of any director, member, or owner of the customer, or
  2. ii) 24 hours of being faxed to any customer’s fax numbers or those of any director, member, or owner, or

iii) On hand delivery to the customer or any director, member, or owner.

 

20.2 The customer agrees that their chosen domicile is at their business or physical address or, in the case of a close corporation, the address of any member.

  1. The customer agrees to the standard rates of J&D Fasteners for any goods or services provided, which rates can be obtained upon request.
  2. The invalidity of any part of this Contract will not affect the validity of any other part.
  3. Orders are subject to cancellation by J&D Fasteners due to force majeure, including, but not limited to, inability to secure products, labor, power, materials, supplies, or due to acts of God, war, civil disturbance, riot, or state of emergency.

14-DAY EXCHANGE OR REFUND POLICY

We will refund or exchange most goods returned within 14 days of purchase, provided they are in their original condition and packaging, and have not been used. The original invoice must be submitted.

EXCLUSIONS FROM THE 14-DAY POLICY

Goods specially ordered for you, or those that were defective, used, repaired, or damaged at the time of sale. Any special buyouts is non refundable.

DEFECTIVE GOODS

Defective goods within the warranty period will be repaired, replaced, or refunded. Returned goods may be assessed by the manufacturer or authorized service center. For defects discovered after the warranty period, repairs will be arranged only after quote approval.

 

WARRANTY EXCLUSIONS

Damage from lightning, power surges, misuse, abuse, use for unintended purposes, or accidental damage.

REFUND PROCESS

Refunds, once approved, will be provided as:

  • Credit note
  • Electronic transfer
  • Credit card reversal (subject to banking delays)
